These terms govern the use of the platform mylocaleyez.com (the "Platform"), operated by Michael Leipold, Kirchstraße 5, 64572 Büttelborn (the "Operator"). The Platform connects persons who request authentic on-location videos ("Requesters") with persons who film such videos on location ("Creators" or "Eyez").
The Operator acts as an intermediary. We bring Requesters and Creators together and may handle communication. Unless expressly agreed otherwise, the Operator is not itself the producer of the videos and does not guarantee that a suitable Creator can be found for every request.
When submitting a request or registering as a Creator you must provide accurate and complete information. You are responsible for keeping your details up to date.
Submitting a request or registration is an invitation for us to find a match; it does not in itself create a binding contract for the production of a video. A binding agreement on scope, timeframe and price is concluded separately once a match is confirmed.
You agree not to request, create or upload content that:
Creators must obtain any necessary permissions (e.g. consent of identifiable persons, permission to film on private property) and comply with local law.
Unless agreed otherwise in an individual order, the Creator grants the Requester the rights of use required for the agreed purpose. Details (scope, exclusivity, duration) are set out in the respective order.
Prices are agreed individually per order. Any platform or service fees will be disclosed before a binding order is placed.
The Operator is liable without limitation for intent and gross negligence and under the Product Liability Act, and for injury to life, body or health. In cases of slight negligence the Operator is liable only for breach of an essential contractual obligation and limited to the foreseeable, typical damage. Any further liability is excluded. This does not affect mandatory statutory liability.
Consumers have a statutory right of withdrawal. Details are set out in our separate Right of Withdrawal notice.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of the country in which the consumer is habitually resident remain unaffected.
Should any provision of these terms be or become invalid, the validity of the remaining provisions remains unaffected.
